Supreme Court Reinstates Matthew Nyindam as MP, Cancels Kpandai Rerun

The Supreme Court has overturned a High Court ruling that annulled the election of Matthew Nyindam as Member of Parliament for the Kpandai Constituency, effectively restoring the New Patriotic Party (NPP) seat.

In a 4–1 majority decision delivered on Wednesday, January 28, 2026, the Supreme Court set aside the ruling of the Tamale High Court, which had previously declared the election invalid and ordered a rerun.

According to the apex court, the Tamale High Court lacked the legal authority to hear the election petition filed by the National Democratic Congress (NDC) parliamentary candidate, as the petition had been submitted outside the legally required time frame.

The ruling followed a judicial review application filed by Lawyer Gary Nimako, Director of Legal Affairs for the NPP. With this decision, the planned parliamentary rerun in Kpandai will no longer take place.

This judgment solidifies Matthew Nyindam’s status as the duly elected MP for the constituency, ensuring the governing party maintains all 87 of its parliamentary seats.

Background to the Case

In December 2025, the Supreme Court instructed the Electoral Commission (EC) to suspend preparations for a Kpandai parliamentary rerun while the case was still pending.

Earlier, the EC had scheduled a rerun for December 30, 2025, after Parliament notified the Commission that the seat had become vacant.

The decision to rerun the election followed a ruling by the Tamale High Court, presided over by Justice Emmanuel Brew Plange, which nullified the December 7, 2024 parliamentary results and ordered a fresh poll within 30 days.

The petition, filed by NDC candidate Daniel Nsala Wakpal, alleged widespread electoral irregularities. He cited discrepancies in Form 8A (the pink sheet) from 41 of the 152 polling stations, claiming the breaches contravened Regulations 39 and 43 of the Public Elections Regulations (CI 127).
