NDC Can Seek Supreme Court Review of Kpandai Ruling, But Success Unlikely — Martin Kpebu

Legal expert Martin Kpebu has warned that although the National Democratic Congress (NDC) can request a review of the Supreme Court’s decision on the Kpandai parliamentary election, the likelihood of overturning the ruling is very slim.

Speaking on Joy FM’s Midday News on Wednesday, January 28, 2026, Kpebu explained the review procedure.

“In the Supreme Court, a party essentially has two opportunities: first, at the ordinary bench, and if that fails, they can file for a review. However, most review applications are unsuccessful. Even when an apparent error exists, it rarely finds favour in the court,” he said.

His remarks come after the Supreme Court, in a 4–1 majority decision, overturned the Tamale High Court judgment that annulled the election of New Patriotic Party (NPP) candidate Matthew Nyindam. The apex court ruled that the High Court lacked jurisdiction and upheld Mr. Nyindam’s position as Member of Parliament for Kpandai.

Despite the decision, the NDC maintains that the case is not closed. Majority Chief Whip in Parliament, Rockson-Nelson Deafeamekpor, said the party remains “grieved” but intends to explore all legal and constitutional options.

“This is not the end. Once we receive the certified true copy of the ruling, we will study it and advise on next steps. There is an option to seek a review, so the matter is far from over,” Mr. Deafeamekpor said.
